General Terms and Conditions

Section 1 – Provider, Scope of Terms
(1) The provider and contractual partner for goods displayed in our online shop "www.gazur.de" is Waks & Sharet GbR, Kreuzbergstr. 9, 10965 Berlin, Germany, Phone: +49 (0)157 71765397, Email: info@gazur.de (hereinafter referred to as "Provider" or "we").
(2) These General Terms and Conditions form an integral part of every contractual agreement between the Provider and the respective customer. Conflicting terms and conditions of the customer are hereby rejected.

Section 2 – Product Offering and Contract Conclusion
(1) The Provider offers the items displayed in this online shop for sale. Color representations on the website may vary slightly depending on the internet browser and monitor settings used by the customer; such minor variations are technically unavoidable. Product selection, contract conclusion, and processing are available in German or English at the customer's choice.
(2) The items presented in the shop constitute a binding offer to contract. By placing an order via the "Buy Now" button (or equivalent binding button), the customer accepts the purchase offer. The Provider confirms contract conclusion via email (Order Confirmation).
(3) Prior to submitting the binding order, the customer is presented with an order summary showing the captured data and key characteristics of the goods. The customer can review and correct input errors or cancel the ordering process entirely.
(4) Upon conclusion of the contract, the Provider sends the contractual text to the customer by email. Simultaneously, the Provider stores the contractual text electronically. If the customer maintains a user account, the contract text remains accessible within their account. Otherwise, the customer is advised to retain the email confirmation.

Section 3 – Pricing and Payment
(1) All product prices are total prices including statutory VAT, excluding shipping costs.
(2) Information regarding shipping costs is available in the respective product description and shipping terms page.
(3) The customer may use the following payment methods:
– PayPal / PayPal Express (PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg)
– Shopify Payments (Shopify International Limited, 3rd Floor, Europa House, Harcourt Building, Harcourt Street, Dublin 2, Ireland; including Credit Card, Klarna, Apple Pay, Google Pay, as offered during checkout)
(4) For advance payment orders (bank transfer), payment is due within one week of receiving order confirmation. The Provider reserves the selected goods for the customer during this period. The Provider reserves the right to cancel the contract and resell the goods if payment is not received on time.
(5) For deliveries to non-EU countries, customs duties, import taxes, or local charges may apply upon receipt. These additional charges are the responsibility of the customer and are beyond the Provider's control.

Section 4 – Shipping and Delivery
(1) Details regarding delivery time are provided in the product descriptions. The delivery period begins, in the case of advance payment, on the day after payment instruction to the transferring bank or, for other payment methods, on the day after contract conclusion, and ends on the expiry of the last day of the period.
(2) If multiple items with different delivery schedules are ordered together, the longest delivery timeframe applies to the combined shipment. Customers requiring faster dispatch of individual items must order them separately.
(3) If delivery fails due to an incorrect or incomplete shipping address provided by the customer, a secondary delivery attempt will only occur if the customer covers the direct reshipping costs.

Section 5 – Consumer Right of Cancellation
(1) Customers purchasing as consumers enjoy a statutory right of cancellation. A consumer is defined as any natural person entering into a transaction for purposes predominantly outside their trade, business, or profession.
(2) For consumers residing outside Germany, the Provider grants a right of cancellation under German statutory provisions even if local jurisdiction provides shorter cancellation periods or stricter formal requirements.

Section 6 – Statutory Warranty Rights
Statutory warranty rights (liability for defects) apply in full to all orders.

Section 7 – Customer-Supplied Materials and Intellectual Property
(1) If a customer provides materials (e.g., logos, images, drawings, or text) for custom product manufacturing, the customer guarantees that they possess all required usage rights and grants the Provider the license necessary to fulfill the order.
(2) The customer indemnifies the Provider against any third-party claims arising from copyright, trademark, design, or personal rights infringement resulting from supplied materials, including reasonable legal defense costs.

Section 8 – Out-of-Court Dispute Resolution
(1) The European Commission provides an Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr.
(2) We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Section 9 – Final Provisions
(1) The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers residing abroad, mandatory consumer protection laws of their country of residence remain unaffected.
(2) Should individual provisions of these General Terms and Conditions be held invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
